\n\n Information on data processing pursuant to art. 13 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”)\n
\n\n\n Below you may find information on the processing of your personal data by\n
\n\n ARTinii Production s.r.o., corporate ID No. 03409759, with its registered office at Hybernská 1034/5, Nové Město, 110 00 Prague 1, Czech Republic (hereinafter “Company” or “controller”) provided in accordance with “GDPR” and related applicable data protection legislation.\n

\n\n The following categories of personal data are processed: name, surname, address, email, phone, information on ID card (personal ID number or passport number or similar number identifying physical person, type of ID card, ID card validity) (hereinafter “personal data”).\n
\n\n\n Processing of personal data is lawful for the following reasons:\n
\n\n\n Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;\n
\n\n Processing is necessary for compliance with a legal obligation to which the controller is subject;\n
\n\n Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.\n
\n\n The purpose of processing personal data is:\n
\n\n\n To fulfil contractual obligations.\n
\n\n To provide services mentioned on the website Mytitle.com.\n
\n\n To fulfil legal obligations to which the controller is subject.\n
\n\n (hereinafter “services”)\n
\n\n The personal data will be stored by the Company no longer than is necessary in accordance with the legal obligations. For further information, please contact the Company.\n
\n\n Source of personal data: Data subjects, public bodies, sources containing publicly accessible information.\n
\n\n Personal data can be processed by:\n
\n\n the Company;\n
\n\n providers of services necessary for compliance with a legal obligation to which the controller is subject;\n
\n\n Google Cloud;\n
\n\n Litecoin;\n
\n\n provider of IT services.\n
\n\n The data that we provide to you for the above purposes or which we obtain during the provision of the services will be stored in a secured database on Google Cloud outside the blockchain but also within the blockchain. Personal data stored within the blockchain are fully anonymised by the following technique: cryptographic hashing. The personal data stored on Google Cloud and personal data stored within the blockchain can be accessed only by the employees of the Company.\n
\n\n We may transfer personal data from a location within the European Economic Area (the “EEA”) to outside the EEA, or from outside the EEA to a location within the EEA.\n
\n\n\n The data protection laws in countries outside the EEA may not be of the same standard as it is within the EEA but we will always achieve the same level of protection of your personal data as it is within EEA by concluding written agreements where necessary.\n
\n\n\n We may use social media sites such as Facebook or LinkedIn. If you use these services, you should review their privacy policy for more information on how they deal with your personal information.\n
\n\n\n We use Google Cloud to store your personal data. Google Cloud is GDPR compliant.\n
\n\n The Company will not use your personal data for automated decision-making (including profiling).\n
\n\n With respect to the processing of your personal data by the Company, you can request the Company:\n
\n\n To give you access to your personal data, whereby you can obtain, in particular, information whether your personal data are being processed, for what purpose, what is the scope of processed data and who has been given access to your personal data, if relevant. You can also be provided with a copy of your personal data undergoing processing;\n
\n\n To rectify inaccurate or incorrect data or to complete incomplete personal data;\n
\n\n To erase the personal data, e.g. if the purpose of processing ceases to apply or if your personal data are processed unlawfully;\n
\n\n To restrict the processing of your personal data;\n
\n\n To data portability, which allows you to obtain personal data concerning you, which you have provided to the Company, in a structured and machine-readable format either for yourself or for another controller; and\n
\n\n To make sure that you are not subject to any automated decision-making.\n
\n\n You can also raise an objection against the processing of your personal data, should the processing of your personal data be based on the lawful basis of legitimate interest by contacting the Company or to lodge a complaint with the Office for Personal Data Protection.\n
\n\n A key feature of the European copyright is the informal nature of protection. A person’s copyright arises automatically when the work is created by the author. The author does not have to apply to an office, they do not have to pay a fee, and they do not have to wait for the completion of a registration procedure. Unlike industrial property rights, protection is therefore simpler and cheaper. The disadvantage is that without documentation in a public register; the author is dependent on supporting evidence.\n
\n\n The purpose of our “Mytitle” service is to protect you against the dangers that occur when you share a previously unpublished work with another person (e.g. a client, producer, publisher, studio, social media, etc.). Your work may subsequently get into the hands of a dishonest person who will attempt to claim authorship of your work.\n
\n\n Perhaps your work has not yet seen the light of day or is in the process of development, and it has not been published under your name. You will have trouble in proving that you have created the work during a copyright dispute. It may even happen that only two people who have seen your work; yourself and a person claiming ownership of your work.\n
\n\n As admissible (or acceptable) indirect evidence of authorship, a person’s \"Mytitle Certificate\" clarifies that you had submitted the work (with a specified time, date, validation of identity, and verification of the file) before any dispute of ownership was discussed.\n
\n\n It is well established in global treaties and agreements that most countries recognise certain inalienable rights of ownership of creative work. The Bern Convention for the Protection of Literary and Artistic Works itself has 177 signatory countries out of 195 countries in the world today. The rights to claim ownership of work begins the moment when the work is created and expressed in a objectively perceptible form. It is not dependent on an entity, be it Mytitle or copyright office. These channels validate a person claims of ownership in a demonstrable way.\n
\n\n Mytitle does not individually verify the characteristics or the content and their relation to the requirements of European copyright and of individual states. Only the validity/security of the timestamp and encrypted backup is the responsibility of Mytitle. Thus, our \"Mytitle\" service is similar to a notary and can serve as an (indirect) proof of work for a specified day and time.\n

\n\n\n These Terms and Conditions for European Customers (hereinafter referred to as the \"Terms and Conditions, EU\") of Mytitle which is a product of the Company ARTinii Production sro Hybernská 1034/5,\n Nové Město PSČ: 110 00 IČO: 034 09 759, incorporated in the Commercial Register C 231255 vedená u Městského soudu v Praze (hereinafter referred to as \"the Seller\") shall regulate in accordance with the provisions of Section 1751 (1) of Act No. 89/2012 Coll., the Czech Civil Code (hereinafter referred to as the “ Civil Code ”), the mutual rights and obligations of the Contracting Parties concluded between the Seller and by another natural person (hereinafter referred to as the \"Buyer\") through the Seller's online store. The online store is operated by the Seller on a website located at the website Mytitle.com\n (hereinafter referred to as the \"Website\"), which offers the following product: record of intellectual property rights and other proprietary rights via permanent, non-erasable entry.\n
\n\n Terms and Conditions, EU do not apply in the following cases:\n
\n\n\n legal entity ordering product in the course of its business activities; or\n
\n\n person ordering product in the course of his or her own profession.\n
\n\n The Terms and Conditions, EU may be amended or supplemented by the Seller. This provision shall not affect the rights and obligations arising during the period of effect of the previous version of the Terms and Conditions, EU.\n
\n\n User Account\n
\n\n\n Upon registration of the Buyer on the website (hereinafter referred to as \"user account\"), the Buyer may order product.\n
\n\n \"When registering on the website and ordering product the Buyer is obliged to correctly and truthfully state all information and data provided.\n
\n\n User account access is secured by username and password. The Buyer agrees to maintain confidentiality regarding the information necessary to access his user account.\n
\n\n The Buyer is not entitled to allow third parties to use the User Account.\n
\n\n The Seller can cancel a user account when the Buyer violates his obligations from Terms and Conditions, EU.\n
\n\n The Buyer acknowledges that the User Account may not be available continuously, and it especially due to the necessary maintenance of hardware and software of the Seller or third parties.\n
\n\n Conclusion of The Terms and Conditions\n
\n\n\n Seller is not obliged to sell product on the website. Section 1732 (2) of the Czech Civil Code does not apply.\n
\n\n The website contains information about the product. The prices of the product are listed including the tax and all related charges.\n
\n\n To order the product, the Buyer will fill in the order form in the website. In particular, the order form contains information about:\n
\n\n\n ordered product (the Buyer inserts the ordered product into the electronic shopping cart of the website);\n
\n\n the method of payment of the purchase price of the product; and\n
\n\n cost information related to delivering the product (hereinafter collectively referred to as the “Order\").\n
\n\n Before sending the Order to the Seller, the Buyer is allowed to check and change the data to be sent to the Seller. The data listed in the Order is declared to be correct by the Buyer. The Seller shall immediately confirm receipt of the Order by email to the Buyer at the Buyer's email address specified in user account or Order (hereinafter referred to as \"Buyer's email address\").\n
\n\n The contractual relationship between the Seller and the Buyer arises upon delivery of the Order acceptance (acceptance) that is sent to the Buyer by email to the Buyer's email address.\n
\n\n The Buyer agrees to use the means of distance communication to conclude the Terms and Conditions, EU.\n
\n\n Price of Product and Payment Terms\n
\n\n\n The price of the product and any costs associated with the delivery of the product under the Terms and Conditions, EU may be paid by the Buyer to the Seller by credit or debit card;\n
\n\n The Buyer's obligation to pay the purchase price is fulfilled at the moment of crediting the relevant amount to the Seller's account.\n
\n\n Any discounts from prices of product provided by the Seller to the Buyer cannot be combined.\n
\n\n In the case of commercial transactions, or if required by law, the Seller shall issue the Buyer a tax invoice. The tax invoice will be issued by the Seller to the Buyer after the price of the product has been paid and will be sent to the Buyer electronic form to the Buyer's email address.\n
\n\n Withdrawal from the Terms and Conditions\n
\n\n\n Buyer acknowledges that § 1837 of the Czech Civil Code applies and it is not possible, inter alia, to withdraw from the Terms and Conditions, EU for the delivery of product that have been modified according to the Buyer's wishes; all Mytitle products are modified according to the Buyer's wishes.\n
\n\n Until the product is received by the Buyer, the Seller is entitled to withdraw from the contract at any time. In such a case, the Seller shall return the purchase price to the Buyer to the account specified by the Buyer.\n
\n\n Rights from Defective Performance\n
\n\n\n Rights and Obligations of the Parties with respect to the Rights of defective performance is governed by the relevant generally binding legal regulations (in particular § 1914 to 1925, § 2099 to 2117 and § 2161 to 2174 of the Czech Civil Code).\n
\n\n Seller is responsible, that upon receipt of, product has no material defects. In case of alleged defect, the Seller is liable to the Buyer that at the time the product were received by the Buyer:\n
\n\n\n the product has properties that the parties have agreed;\n
\n\n the product is fit for the purpose for which it is used by the Seller or to which products of this kind are usually used;\n
\n\n the product corresponds to the quality or design of the agreed sample or template, if the quality or design was determined according to the agreed sample or template; and\n
\n\n the product complies with legal requirements.\n
\n\n Other Rights and Obligations of the Parties\n
\n\n\n In relation to the Buyer, the Seller is not bound by any codes of conduct within the meaning of Section 1826 (1) (a). e) of the Czech Civil Code.\n
\n\n Out-of-court settlement of consumer complaints is provided by the Seller via the following email address: support@mytitle.com . The Seller shall send the Buyer's complaint to the Buyer's email address.\n
\n\n Trade control is carried out within the scope of its competence by the relevant Trade Licensing Office. The Czech Trade Inspection Authority performs, to a limited extent, supervision of compliance with Act no. 634/1992 Coll., On Consumer Protection, as amended.\n
\n\n The Buyer hereby assumes the risk of changing circumstances within the meaning of Section 1765 (2) of the Czech Civil Code.\n
\n\n Protection of Personal Data\n
\n\n\n The protection of personal data of the Buyer who is a natural person is provided by Act no. 101/2000 Coll., On Personal Data Protection, as amended.\n
\n\n Buyer agrees to process their personal data: first name, surname, home address, and identification number, tax identification number, email address and phone number, (hereinafter collectively referred to as “personal data\").\n
\n\n The Buyer agrees with the processing of personal data by the Seller for the purpose of realization of rights and obligations from Terms and Conditions, EU and for the purpose of maintaining a user account. The Buyer may also opt to consent to the processing of personal data by the Seller as well as for the purpose of sending commercial messages and information to the Buyer.\n
\n\n The Buyer acknowledges that he is obliged to keep his personal data (at registration, in his user account, when ordering from the website) and truthfully and that he is obliged to inform the Seller without undue delay of any change in the Buyer's personal data.\n
\n\n The Seller may authorize a third party to process the Buyer's personal data as a processor, as is necessary to fulfil the service.\n
\n\n Personal data will be processed indefinitely. Personal data will be processed in electronic form in an automated manner or in printed form in a non-automated manner.\n
\n\n The Buyer confirms that the personal information provided is accurate and that he or she has been advised that he or she has voluntarily provided personal data.\n
\n\n In the event that the Buyer believes that the Seller or the Processor (Art. 9.5) is processing its personal data that is contrary to the protection of the Buyer's privacy or in violation of the law, the Buyer may:\n
\n\n\n ask the Seller or processor for explanation\n
\n\n require the Seller or processor to discontinue processing its personal data in this way.\n
\n\n If the Buyer asks for information on the processing of their personal data, the Seller is obliged to provide this information. The Seller has the right to request a reasonable reimbursement for providing the information not exceeding the costs necessary for providing the information.\n
\n\n Sending Commercial Communications and Storing Cookies\n
\n\n\n The Buyer agrees to receive information related to the product or business of the Seller via email and further agrees to receive commercial communications from the Seller via email.\n
\n\n Buyer agrees to store so-called cookies on his computer, which will enable him or her to gain the full benefit of the product. Though, the Buyer may withdraw consent to store so-called cookies on his computer at any time, which may interfere with the Buyer’s ability to gain the full benefit of the product.\n
\n\n Delivery\n
\n\n\n The product may be delivered to the Buyer's email address.\n
\n\n Final Provision\n
\n\n\n Parties agree that the relationship is governed by the procedural laws and courts of the Republic of Ireland, including conflict of law laws and the substantive laws of the Czech Republic. This does not prejudice consumer's rights arising out of generally binding legal regulations.\n
\n\n The invalidity or ineffectiveness of one provision shall not affect the validity of the other provisions of the Terms and Conditions, EU.\n
\n\n Attachment business conditions form a model form for withdrawal from the contract.\n
\n
